These Terms of Use (“Terms”) apply to the ForeGolf mobile application (hereby referred to as the “Application”) developed by Skillset Studios, MB (hereby referred to as the “Service Provider,” “we,” “us,” or “our”).
The Application is provided as a Freemium service.
By downloading, accessing, or using the Application, you agree to be bound by these Terms of Use. Please read them carefully before using the Application.
If you do not agree with these Terms, you should discontinue using the Application.
Use of the Application
ForeGolf is a golf-related application designed to help users discover golf courses, track rounds, record scores, view golf statistics, access GPS-based information, and share golf-related content.
The Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes in accordance with these Terms and applicable laws.
You agree not to:
Copy, modify, distribute, sell, lease, or sublicense the Application or any part of it without authorization.
Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Application, except where permitted by applicable law.
Create unauthorized derivative works based on the Application.
Use the Application for unlawful, fraudulent, or harmful purposes.
Attempt to gain unauthorized access to the Application, its systems, or other users’ accounts.
Interfere with the functionality, security, or performance of the Application.
Use automated systems to extract, scrape, or collect data from the Application without permission.
All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider or its respective licensors.
User Accounts
Certain features of the Application may require you to create an account.
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.
You agree to provide accurate information when creating or maintaining your account.
You must notify the Service Provider if you suspect unauthorized access to your account.
The Service Provider reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or threaten the security or integrity of the Application.
Golf Scores, Statistics, and Round Tracking
The Application allows users to record, manage, and analyze golf-related information, including scores, rounds, scorecards, and performance statistics.
You acknowledge that:
Golf scores and statistics may depend on information entered by you.
The accuracy of recorded information is your responsibility.
Certain statistics and calculations may be estimates.
Information may occasionally be incomplete, inaccurate, or unavailable due to technical errors or third-party data limitations.
The Application is not an official golf scoring or handicap certification service unless explicitly stated otherwise.
The Service Provider does not guarantee that scores, statistics, handicap estimates, or other calculated information will be accepted by golf clubs, tournament organizers, or official handicapping authorities.
You are responsible for verifying information before using it for official competitions or other purposes.
GPS and Golf Course Information
The Application may provide GPS-based features, golf course maps, distances, geographic information, and other location-related functionality.
This information is intended for general informational and recreational purposes.
You acknowledge that GPS accuracy may be affected by various factors, including device capabilities, satellite signal quality, environmental conditions, internet connectivity, and the availability of geographic data.
The Service Provider does not guarantee the accuracy, completeness, or availability of:
GPS distances and measurements.
Golf course locations and boundaries.
Greens, hazards, bunkers, and other course features.
Course layouts and hole information.
Par values, yardages, and other course details.
Other geographic or golf-related information.
Golf course information may be obtained from external data sources and may not always reflect recent changes to a course.
You are responsible for verifying relevant information and exercising appropriate judgment while playing golf.
The Application should not be relied upon for navigation in dangerous situations or for making safety-critical decisions.
User-Generated Content and Sharing
The Application may allow users to create, save, export, and share golf-related content.
Such content may include:
Golf scorecards and round summaries.
Scores, statistics, and performance information.
Images, photographs, and screenshots.
Golf course information associated with completed rounds.
Other content created or submitted through the Application.
You retain ownership of the original content you create or upload, subject to any rights held by third parties.
By uploading, submitting, or sharing content through the Application, you confirm that you have the necessary rights and permissions to use and share that content.
If you choose to share content with other users, external applications, social media platforms, or third-party services, you acknowledge that the shared content may become visible to others depending on the method of sharing and the privacy settings of the destination platform.
The Service Provider is not responsible for how third parties use, distribute, modify, or store content after you voluntarily share it outside the Application.
You are responsible for reviewing the content before sharing it, including any personal information, location details, images, or other information that may be included.
You agree not to upload, create, or share content that:
Violates applicable laws or regulations.
Infringes copyrights, trademarks, privacy rights, or other rights belonging to third parties.
Contains unlawful, threatening, abusive, or harassing material.
Contains malicious software or harmful code.
Impersonates another individual or misrepresents its origin.
Is intended to defraud, deceive, or harm others.
Where content is uploaded to or shared through services operated by the Service Provider, you grant the Service Provider a non-exclusive, worldwide, royalty-free license to store, process, reproduce, display, and transmit that content solely as reasonably necessary to operate the Application and provide its features.
This license does not transfer ownership of your content to the Service Provider.
The Service Provider reserves the right to remove or restrict access to content that violates these Terms or applicable laws, subject to applicable legal requirements.
Content Accuracy and User Responsibility
The Service Provider does not independently verify all user-generated content, recorded golf scores, or shared information.
Users are responsible for the accuracy and legality of the information they submit.
The Service Provider does not endorse or guarantee the accuracy of content created or shared by users.
If you choose to rely on information provided by other users, you do so at your own discretion and risk.
Subscriptions and In-App Purchases
The Application may offer free features as well as optional paid subscriptions or premium functionality.
If you purchase a subscription through the Apple App Store, payment will be processed through your Apple Account in accordance with Apple’s applicable terms and conditions.
Subscription prices, billing periods, and available features will be displayed before purchase.
For automatically renewing subscriptions:
Payment will be charged to your Apple Account upon confirmation of purchase.
Subscriptions automatically renew unless canceled before the current subscription period ends.
Renewal charges will be based on the subscription terms and prices disclosed to you, subject to applicable notice requirements.
You can manage or cancel subscriptions through your Apple Account settings.
Canceling a subscription generally prevents future renewals but does not automatically provide a refund for the current billing period.
Any free trial, if offered, will be subject to the terms disclosed at the time of enrollment.
Refunds and cancellations are handled in accordance with Apple’s applicable policies and mandatory consumer protection laws.
The Service Provider reserves the right to modify subscription offerings, pricing, and premium features, subject to applicable laws and any required notices.
Third-Party Services
The Application may use third-party services to analyze application usage, monitor performance, identify technical issues, and improve functionality.
These services may be subject to their own terms and privacy policies.

The Service Provider is not responsible for the independent practices or services of third parties, except where responsibility cannot be excluded under applicable law.
Internet Connectivity and Device Requirements
Certain features of the Application require an active internet connection.
The connection may be provided through Wi-Fi or your mobile network provider.
The Service Provider cannot guarantee that all features will function correctly without internet access or when connectivity is limited.
If you use the Application through a mobile network, your mobile provider’s terms and charges may apply.
You are responsible for any applicable data usage charges, roaming fees, or other costs imposed by your network provider.
You are also responsible for maintaining a compatible device with sufficient battery power and available storage.
The Service Provider is not responsible for interruptions caused by network outages, device limitations, insufficient battery power, or other circumstances outside its reasonable control.
Device Security
The Application may store or process information necessary to provide its features.
You are responsible for maintaining the security of your device and account.
The Service Provider recommends against using devices with unauthorized modifications that compromise operating system security.
Such modifications may expose your device to security risks, malicious software, or compatibility issues.
The Service Provider cannot guarantee that the Application will function correctly on modified or unsupported devices.
Intellectual Property
All rights, titles, and interests in the Application, including its design, software, graphics, branding, features, and underlying technology, belong to the Service Provider or its licensors.
You may not reproduce, distribute, modify, or commercially exploit any part of the Application without prior written permission, except as permitted by applicable law.
Golf course names, trademarks, logos, and other third-party materials remain the property of their respective owners.
Nothing in these Terms grants you ownership of the Application or any intellectual property belonging to the Service Provider.
Availability and Modifications
The Service Provider aims to keep the Application reliable, functional, and up to date.
However, the Service Provider does not guarantee uninterrupted access to the Application or that all features will always be available.
The Service Provider may introduce, modify, suspend, or discontinue features to improve functionality, maintain security, comply with legal requirements, or address operational needs.
Certain updates may be required for continued use of the Application.
The Service Provider does not guarantee compatibility with every device or operating system version.
Where changes materially affect paid services or your legal rights, the Service Provider will provide notice and any remedies required by applicable law.
Limitation of Liability
The Application and its content are provided on an “AS IS” and “AS AVAILABLE” basis to the extent permitted by applicable law.
While the Service Provider makes reasonable efforts to maintain accurate information and reliable functionality, it does not guarantee that the Application will be error-free, uninterrupted, or suitable for every particular purpose.
To the maximum extent permitted by applicable law, the Service Provider shall not be liable for indirect, incidental, special, or consequential losses arising from the use of the Application.
This may include losses resulting from:
Inaccurate GPS measurements or golf course information.
Incorrect or incomplete golf scores and statistics.
Temporary service interruptions or technical failures.
Loss of locally stored information due to device failure.
Internet connectivity issues.
Unauthorized access resulting from circumstances outside the Service Provider’s reasonable control.
Content voluntarily shared by users through third-party platforms.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer rights and liability arising from intentional misconduct or gross negligence where applicable.
Termination
You may stop using the Application at any time by uninstalling it.
If you have created an account, you may request account deletion in accordance with the Application’s Privacy Policy.
The Service Provider may suspend or terminate your access if you materially violate these Terms, engage in fraudulent activity, or misuse the Application.
Where reasonably possible and legally required, the Service Provider will provide appropriate notice before terminating access.
Termination does not automatically cancel subscriptions managed through the Apple App Store. You must manage those subscriptions through your Apple Account.
Upon termination, your right to use the Application may end, subject to any rights that continue under applicable law.
Privacy
Your privacy is important to us.
The collection, use, storage, and processing of personal information are described in our Privacy Policy.
By using the Application, you acknowledge that you have been informed about our privacy practices.

Changes to These Terms
The Service Provider may update these Terms from time to time to reflect changes in the Application, its features, applicable laws, or business operations.
Updated Terms will be published on this page with a revised effective date.
Where required by law, the Service Provider will provide additional notice of material changes.
Your continued use of the Application after updated Terms take effect may constitute acceptance of those changes where permitted by applicable law.
If you do not agree with the updated Terms, you should discontinue using the Application.
Governing Law
These Terms are governed by the laws of the Republic of Lithuania, without prejudice to mandatory consumer protection rights applicable in your country of residence.
Any disputes relating to these Terms shall be resolved in accordance with applicable laws and the jurisdictional rules protecting consumers.
